Judge Refuses to Dismiss AT&T Surveillance Lawsuit

Despite increased pressure from the Bush administration, U.S. district judge, Vaughn Walker, has refused to dismiss a lawsuit alleging that AT&T Inc. complied with the government’s illegal wiretapping and surveillance program.

“I do think these are matters we can proceed on,” Walker said at a hearing in San Francisco, rejecting claims that proceedings in the case could endanger national security. The hearing was attended by about 50 attorneys representing class action law firms, nonprofit groups, telecom providers, and the government.

The judge’s ruling is yet another victory for the Electronic Frontier Foundation, which filed the lawsuit back in January, alleging that the top U.S. telephone provider agreed “to assist the government in its secret surveillance of millions of ordinary Americans.”
