TiVo Wins DVR Patent Lawsuit Against EchoStar Communications

Shares in TiVo Inc. surged almost 29% yesterday after the DVR manufacturer won a key patent infringement lawsuit against satellite television giant, EchoStar Communications.
The U.S. Court of Appeals for the Federal Circuit in Washington D.C. affirmed a lower court ruling which determined that EchoStar’s digital video recorders infringed on TiVo’s patented “time warp” technology. Damages of $74 million against EchoStar were upheld.
The U.S. Patent and Trademark Office reexamined the relevant patent last year, on a request from EchoStar, and determined that it is valid, affirming the strength of TiVo’s intellectual property in the home entertainment industry.
